THIS IS A PUBLIC AUCTION OPEN TO ALL AUSTRALIAN AND NZ WESTERN HORSE ENTHUSIASTS

•  If you agree to our terms after reading the following, you will need to fill out the consignment form in its entirety (which follows) before we can accept your horse for consignment.

• Seller has the right to set a reserve price on the nominated horse. This amount shall only be disclosed on the nomination form and will remain confidential.  AWHSC respects the privacy of the buyer all negotiations will remain the responsibility of the seller and the buyer.

•  The consignment fee is to be prepaid and sent to AWHSC   The consignment fee is non-refundable.

•  Photos, or any other pertinent data may be sent via e-mail to AWHSC or mailed to AWHSC Consignors are hereby bound by the Terms and Conditions of Consignment (completion of Consignment Form/Intent to Sell) as well as Terms and Conditions of Sale.

•  Horses and all pertinent information received will be posted, displayed, and given a lot/hip number on auction site once consignment fee has been paid. If payment is made by direct deposit to account AWHSC or money order, horse will be listed within 48 hours. If payment is made by check, listing will be made after check clears the bank, 7-10 business days.

•  The Seller and Buyer (highest bidder) will be notified automatically via e-mail within 24 hours of completion of sale.  You are then responsible for contacting each other to make final arrangements including payment, shipping, and paperwork on animal purchased.

•  The Seller and Loosing bidder will be notified that the reserve price has not been met, automatically via e-mail within 24 hours of completion of sale. All further negotiations will be the responsibility of each party.

•  HYPP status/ test results, must be disclosed on any horses descended from the QH stallion Impressive.

•  BROODMARE status, if known, must be disclosed on any mare in foal.  It MUST be stated if mare has been " Vet Checked " or " Believed to Be " in foal.  If mare has been vet checked in foal, certificate/paperwork should be included with other paperwork at time of transfer of ownership.  Any guarantees are totally between seller and buyer not AWHSC

•  Seller/Consignor has the right to Pass Out/remove any horse up for auction as long as the Reserve bid, if one has been set, has NOT been met. Seller/Consignor must notify AWHSC within 24 hours of highest bid at close of auction requesting to pass out (PO) the horse. If Reserve bid has been met, Seller is bound by Terms and Conditions to sell said animal. 

•  Seller/Consignor is responsible for representing the horse offered in a truthful and respectful manner. N.B. If the horse is known to or has been seen displaying the vice of *windsucking the Seller/Consignor MUST disclose this information to all bidders. * "Windsucker" shall mean a horse which suffers from the vice of noisily drawing in and swallowing air through its mouth.

•  Seller/Consignor is prohibited from withdrawing any horse from the auction site after consignment except for health reasons, in which case, a written veterinarian statement is required.  Consignment fee will be refunded or seller/consignor may choose to list horse in auction at a later date.

•  Seller/Consignor agrees that the sole intent is to list and sell their animal at a stipulated price.  ..AWHSC. in return will showcase their animal and all pertinent information in a professional manner to the internet community in a totally automated format to best facilitate the  sale of said horse.

RULES OF THE ROAD

The information below helps to show the uses, terms, and responsibilities of AWHSC and it's associated sites, and the members. This information will serve as general instructions. 

The Internet being the fragile environment that it is, AWHSC and it's associated sites cannot be held responsible for server down time, or your inability to access our site. Notifications sent by email may take longer than expected, and cannot be counted on to inform you of a Lot's status. In the event of technical problems, we reserve the right to cancel, restart, or extend an auction as the circumstances may dictate.

AUCTION GUIDELINES

In order to bid on or buy a Lot, you must first register with AWHSC. There is no charge for registering. On every Lot in an auction, a minimum bid of $1000 and a minimum increase of $100 is set. Our software will not accept a lower bid than either the opening bid, or the current bid plus the minimum increase.

*note* If an inappropriate bid is placed, a bidder will be notified immediately that their bid has not been accepted, and is provided with a form to correct the bid. Any current high bidders who are overbid at this time will receive notification by email.

ENDING DATES

Each Lot is listed for four (4) weeks. The ending time will be 5:00 pm EST on the final day of those four (4) weeks . This time will be posted on each individual Lot listed. Lots end automatically at this time. The Lots remain viewable till midnight EST of that day, whereupon notifications are sent out to the winning bidders

AUCTION RESULTS

The results of Lots won in auctions are displayed for a period of time on the main auction pages. By selecting an auction, the results for that auction will display the Lot, purchase price and winning bidders **(unless the AWHSC is otherwise advised by the winning bidder)** .
This information is provided as a service to our users, and should be used as a guideline to determine the market for a given Lot.

BUYER RESPONSIBILITIES

By placing a bid, you are legally and ethically bound to purchase the Lot should you be the highest bidder at the end of the auction. Fraudulent bids are not tolerated, and any recourse we feel necessary will be taken. Failure to pay for Lots won may result in removal from our services,  public notice on our site, as well as in any appropriate newsgroups.

  1. Online AWHSC . is run as a service for the horsemen in the internet community.  While we expect that all Lots are well represented, We take no responsibility for the condition or quality of Lots presented herein.  AWHSC disclaims any guarantees expressed or implied on Lots listed on our site.
  2. Bidders or prospective buyers are advised to thoroughly read and examine all information provided on any animal you are interested in bidding on or purchasing.  Direct contact with the vender/seller is encouraged. If you are unsure, ask.
  3. All sales are "as is" and no animals can be returned unless there is an arrangement made between buyer and seller.  AWHSC has NOT vet checked any of the horses for sale.  There is no guarantee by AWHSC of soundness or any other qualities of any horse in this sale unless expressly made by the seller.  In these cases the guarantee is strictly by the seller and not by AWHSC .  Any misrepresentation must be dealt directly with the seller and not through AWHSC .
  4. We at AWHSC do not participate in any exchange of money or arrange for the delivery of any animal purchased through the sale.  We do not take responsibility for any guarantees or representations made by the seller or the bidder.  All details of the transaction must be completed by seller and buyer.  Seller to provide necessary paperwork, registration papers and transfers, if applicable.  Seller is also obligated to make known all defects, if any, prior to time auction begins.  If seller defaults in this clause, the buyer may have the right to refuse subject animal.  In which case, seller is still responsible for all charges incurred with AWHSC . Buyers may, at their own expense, have a veterinarian examine any horse prior to the sale by making arrangements with the seller.  If misrepresentation is determined on the seller's part, their registration and contract with AWHSC will be terminated immediately.  The name of the seller and/or business will be placed in the AWHSC 's file as an undesirable.
  5. AWHSC is committed to advertising, displaying all information, automated communication and bidding to give the seller the best opportunity to sell his horse/horses for the price he or she wants.
  6. All horses sold through AWHSC Auction should be registered with their respective breeds and a copy of registration papers should be available for viewing at the request of the bidder. Young stock may be listed as "registration pending" but upon request a bidder should have access to copies of registration applications etc.
  7. The auction will list if mares are in foal. If they are listed as being vet checked or guaranteed in foal, buyer has the right to view the documentation supplied by the practitioner pronouncing the pregnancy. If mare is listed as "Believed to Be" in foal, it is up to the buyer to investigate further regarding pregnancy tests or veterinary exams.  Any agreements regarding return breeding, Live foals, etc. are solely between the seller and buyer.


    BIDDING
  8. The highest bidder will be the buyer. If a dispute should arise between two or more bidders, the horse will then be auctioned between the disputing parties.  If they choose not to bid, the last bid recognized by AWHSC will then be the buyer.
  9. Bidders may place a "Maximum" bid and the auction will place their bids automatically until their maximum bid is met.  If it is surpassed, you will then receive an outbid notice via e-mail. This service is for your convenience and by no means a requirement.
  10. 10. AWHSC . reserves the right to decline any bids made by individuals and any bidders  who have defaulted in prior auctions or any individuals whose auction privileges have been terminated.
  11. Bidders may contact sellers through the auction format to request pertinent information or ask additional questions about any horses consigned.
  12. Sellers retain the right to no sale or pass out any horses they have consigned as long as a minimum bid has not been met or surpassed.


    PURCHASE
  13. The highest bidder will receive notice at the close of auction of winning bid.  Payment terms are to be made with the seller.  The cost of shipping is not included in the auction price.  All shipping fees are to be paid by the buyer unless other arrangements have been made between buyer and seller.  All details of the transaction are the responsibilities of the seller and buyer. If buyer has not made payment to seller within agreed amount of time set by seller, it will then be considered a default sale.  Any legal fees that may be incurred by the seller to obtain purchase price and any other fees agreed upon between both buyer and seller including attorney fees and costs will be the responsibility of the default buyer.
  14. In the unlikely event a bid is not honored, the registered buyer's registration and contract with AWHSC . will be terminated. Seller may then request a resale of the horse in question or request AWHSC to accept the next highest bid.  If any prior bid cannot be enforced, seller agrees not to hold AWHSC responsible and may request the horse to be placed in another auction for resale.
  15. All responsibilities, care, maintenance, transport, and expense of auctioned horse will be determined by negotiations between the buyer and the seller. AWHSC encourages buyers to insure the lot purchased as soon as monies change hands.  AWHSC assumes no liability for horse's health/welfare at any time, this responsibility falls directly to the seller before sale and the buyer after negotiations with the seller.
  16. These terms and conditions of sale shall constitute a contract between buyers, sellers, and AWHSC . and shall be equally binding among all parties.

    GST - The Seller must disclose GST status at time of nomination.  GST status will be displayed on each lot nominated.

It is a violation of law to make bids in a false name. Please be aware that even if you do not give us your real name, your web browser transmits a unique internet address to us which can be used by law enforcement officials to identify you. Please don't ruin the fun for everyone by testing our auction with false bids. This puts you at substantial personal legal risk. Fraudulent bidders will be prosecuted to the fullest extent of the law. Currently, the Federal Police are responsible for investigating all Internet fraud cases.

**Any person/s found to be in violation of any clause stated herein will have their name added to a public list which will be available on the AWHSC Auction site.**
